Divinium Terms of Service Preamble: By accessing, purchasing, downloading, installing, or utilizing in any manner the software, services, or related materials (collectively, the "Software") provided by Divinium ("we," "us," "our," or "Divinium"), you ("User," "you," or "your") irrevocably, unconditionally, and perpetually agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Divinium, governing your use of the Software. Failure to read, understand, or acknowledge these Terms does not absolve you of your obligations hereunder. If you do not agree to every provision contained within these Terms, you are expressly prohibited from any and all use of the Software and must immediately cease all interaction with our services, platforms, or products. 1. Acceptance of Terms 1.1 Binding Agreement: Your use of the Software constitutes your explicit, irrevocable acceptance of these Terms in their entirety. By proceeding with any interaction involving Divinium, including but not limited to browsing our website, purchasing a license, or downloading the Software, you affirm that you have read, comprehended, and agreed to these Terms. 1.2 Modifications: Divinium reserves the unilateral, unrestricted right to modify, amend, or revise these Terms at any time, for any reason, without prior notice. Continued use of the Software following such changes constitutes your acceptance of the revised Terms. You are solely responsible for reviewing these Terms periodically to ensure compliance. 2. License Grant and Restrictions 2.1 Limited License: Subject to strict adherence to these Terms, Divinium grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software solely for the purposes explicitly authorized by Divinium. This license is conditional upon full payment of all applicable fees and compliance with all Terms herein. 2.2 Restrictions: You expressly agree not to engage in, facilitate, or permit any of the following: (a) Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying structure of the Software. (b) Copying, modifying, distributing, selling, leasing, sublicensing, or creating derivative works of the Software, in whole or in part. (c) Using the Software for any unlawful, fraudulent, or malicious purposes, including but not limited to bypassing anti-cheat systems, manipulating game environments, or engaging in activities that violate third-party terms of service. (d) Circumventing, disabling, or interfering with security features, license validation mechanisms, or digital rights management protocols embedded within the Software. (e) Sharing, lending, leasing, or otherwise transferring your license key, account credentials, or access to the Software to any third party. (f) Using the Software in a manner that could harm, disrupt, or impair Divinium’s servers, networks, or other users, as determined solely by Divinium. 3. Termination of License 3.1 Grounds for Termination: Divinium reserves the absolute, unrestricted right to terminate your license to the Software immediately, without prior notice, refund, or liability, for any reason, including but not limited to: (a) Any violation, suspected violation, or attempted violation of these Terms, regardless of intent or severity. (b) Misuse, abuse, or unauthorized modification of the Software, as determined in Divinium’s sole discretion. (c) Engaging in activities deemed harmful to Divinium’s business interests, reputation, or user community. (d) Suspicion of license key sharing, resale, or unauthorized distribution. (e) Initiation of chargebacks, payment disputes, or fraudulent financial activity related to the Software. 3.2 Post-Termination Obligations: Upon termination, you must immediately: (a) Cease all use of the Software and destroy all copies in your possession. (b) Delete any associated files, documentation, or materials related to the Software. (c) Forfeit all fees paid, with no entitlement to refunds, credits, or compensation. 4. Sales, Refunds, and Chargebacks 4.1 All Sales Final: All purchases of Divinium Software are irrevocably final. Under no circumstances, including but not limited to dissatisfaction, incompatibility, accidental purchase, or license termination, will refunds, credits, or exchanges be granted. 4.2 No Exceptions: You expressly waive any right to seek refunds through Divinium, payment processors, financial institutions, or legal avenues. Refunds will only be issued if explicitly mandated by binding legal authority in your jurisdiction, and even then, solely at Divinium’s discretion. 4.3 Chargeback Prohibition: You agree not to initiate chargebacks, payment disputes, or reversals for any reason. Any such action constitutes a material breach of these Terms and will result in immediate license termination, forfeiture of all fees, and potential legal action to recover losses, including legal fees and penalties. 5. Prohibited Uses and Consequences 5.1 Anti-Cheat Evasion: The Software is not intended, authorized, or permitted for use in circumventing anti-cheat mechanisms, evading hardware bans, or engaging in cheating within video games or other software. Any such use is strictly prohibited and voids all rights under these Terms. 5.2 Liability for Misuse: Divinium disclaims all liability for consequences arising from prohibited use, including but not limited to account suspensions, hardware bans, legal penalties, or reputational damage. You assume full responsibility for all risks and damages resulting from misuse. 6. Intellectual Property 6.1 Ownership: All rights, title, and interest in the Software, including intellectual property, trademarks, and proprietary technology, are the exclusive property of Divinium. These Terms grant no ownership rights, and any unauthorized use constitutes infringement. 6.2 Enforcement: Divinium will aggressively pursue legal action against any infringement, including injunctive relief, damages, and recovery of legal costs. 7. Disclaimer of Warranties 7.1 As-Is Basis: The Software is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. Divinium expressly disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. 7.2 No Guarantees: Divinium does not guarantee uninterrupted, error-free, or secure operation of the Software. You acknowledge that use may result in unforeseen consequences, including data loss or system instability. 8. Limitation of Liability 8.1 Exclusion of Damages: To the fullest extent permitted by law, Divinium shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Software, including but not limited to lost profits, data loss, or reputational harm. 8.2 Liability Cap: In no event shall Divinium’s total liability exceed the amount paid by you for the Software. 9. Governing Law and Dispute Resolution 9.1 Jurisdiction: These Terms are governed by the laws of Germany, excluding conflict of law principles. 9.2 Venue: Any disputes shall be resolved exclusively in the courts of Germany, and you irrevocably submit to their jurisdiction. 10.
